1. General Provisions
1.1. These Terms and Conditions (hereinafter referred to as the “Terms”) constitute a legally binding agreement between the Buyer (natural or legal person) and the Seller – Pyromega GmbH – governing the purchase and delivery of goods through the Seller’s online store.
1.2. By using the online store and submitting an order, the Buyer agrees to these Terms. The Seller reserves the right to amend these Terms at any time in accordance with applicable legal requirements. Changes shall be published on the Seller’s website and apply from the time of their publication.
1.3. The following persons have the right to use the online store:
- Natural persons with full legal capacity (minimum 18 years);
- Minors aged 14–18 with parental or guardian consent, unless they are independently managing their income;
- Legal entities;
- Authorized representatives of the above.
1.4. The contract between the Buyer and the Seller becomes effective when the Buyer completes the ordering process and clicks the “Confirm Order” button.
2. Personal Data Protection
2.1. Buyers may place orders by registering an account or as a guest.
2.2. During the ordering process, the Buyer must provide accurate personal data, including name, delivery address, telephone number, and email address.
2.3. By accepting these Terms, the Buyer agrees to the processing of their personal data for order fulfillment, service improvement, and direct marketing purposes, in accordance with the EU General Data Protection Regulation (GDPR).
2.4. The Seller will not disclose personal data to third parties without the Buyer’s consent, except as required by law.
2.5. The Buyer is responsible for keeping login credentials confidential.
3. Seller’s Rights and Obligations
3.1. The Seller may temporarily or permanently suspend access to the online store for maintenance or other justified reasons.
3.2. If the Buyer attempts to disrupt the store’s operation or violates these Terms, the Seller may restrict or terminate access without notice.
3.3. The Seller reserves the right to cancel any unpaid order after 3 working days.
3.4. If a product becomes unavailable, the Seller will inform the Buyer via email or phone and offer a replacement or refund.
3.5. The Seller undertakes to sell goods in compliance with applicable German and EU legal standards, including CE certification for fireworks.
4. Buyer’s Rights and Obligations
4.1. The Buyer agrees to comply with these Terms and must not use the goods in a manner contrary to their intended purpose or legal restrictions.
4.2. The Buyer is responsible for accepting the goods and making payment as agreed.
4.3. The Buyer has the right to withdraw from the contract within 14 days after placing an order. After the two weeks the purchase is final.
5. Ordering, Payment, and Delivery
5.1. The online store is available 24/7.
5.2. All orders must be paid in advance via credit/debit card, or direct bank transfer to PyroMega GmbH bank account. All associated transaction fees are covered by the Seller.
5.3. Orders not paid within 3 working days will be cancelled.
5.4. Purchased goods must be collected during the designated sales period. A maximum of 25 kg of fireworks may be collected per person (minimum age 18) for transport to the Netherlands.
5.5. The Buyer must inspect the goods upon collection. Complaints after acceptance are not possible.
6. Product Warranty and Liability
6.1. The Seller guarantees that all goods meet legal safety and quality standards set by German authorities.
6.2. The Seller is not liable for damage resulting from misuse of the goods (e.g., use in enclosed spaces, during poor weather conditions, or post-modification by the Buyer).
6.3. Liability for indirect or consequential damages is excluded unless caused by gross negligence or willful misconduct.
7. Alternative Dispute Resolution
7.1. The European Commission provides an online dispute resolution platform (ODR): http://ec.europa.eu/consumers/odr.
7.2. Pyromega GmbH is neither obligated nor willing to participate in dispute resolution before a consumer arbitration board under the VSBG (Consumer Dispute Resolution Act).
8. Miscellaneous
8.1. In case of out-of-stock items, a comparable or higher-value substitute may be offered.
8.2. Prices and product descriptions are subject to change without prior notice.
8.3. Fireworks categories and age restrictions:
- Category 1: from 12 years;
- Category 2 and 3: from 18 years; If no category is shown, the packaging label applies (minimum 18 years).
9. Final Provisions
9.1. These Terms and Conditions are governed by German law.
9.2. The Buyer agrees to regularly review the Terms. Each use of the service confirms acceptance of the current version.
